2005 South Florida Legal Guide : John W. Kozyak, Harley S.
Tropin, Charles W. Throckmorton, Laurel M. Isicoff, and Detra P. Shaw-Wilder
(Up-and-Comer). With just 250 lawyers listed, out of a total pool of
approximately 23,000 members of the Florida Bar in South Florida, the
South Florida Legal Guide publishes roughly the top one percent
of the area's attorneys. The South Florida Legal Guide employs
a ballot research method from which they cull the lists.
The determination begins with the lawyers they ballot. The ballots
are then scrutinized to collect a first draft of names, following
which trusted sources in the legal community are consulted to provide
further insight. Up-and-Comers are nominated by Top Lawyers once the
Top Lawyer list has been finalized. The Guide also named Kozyak
Tropin & Throckmorton as one of the Top 100 Law Firms in South Florida.

(Up-and-Comer). Selected for inclusion on this list by their peers in
the legal field, the 2004 “Florida Legal Elite” names the top 846 lawyers
who have earned the trust and confidence of those who know their work
the best. This prestigious group represents the top 1.6% of the 54,135
Florida Bar members who practice in the state.
- John Kozyak was part of a team of Assistant U.S.
Attorneys, FBI and IRS agents, which was presented the National Crime
Victims Service Award by Attorney General Ashcroft on April 22, 2004,
during the federal commemoration of National Crime Victims Rights Week.
John served as restitution receiver in the U.S. v. Brandau et al.
case, where Mr. Brandau was sentenced to 55 years in prison. He was
also the bankruptcy trustee for Financial Federated, the company
used to promote a large Ponzi Scheme, involving viatical contracts,
resulting in 3400 victims losing $134 million. John, KT&T and the
government helped the victims recover approximately 20% of their investments
and kept them informed of developments in this complicated case, through
frequent, comprehensive status reports and a website. More information

On August 11, 2003, after only two days of
trial in U.S. Federal Court in Ft. Lauderdale, KT&T attorneys
Harley Tropin and Tucker Ronzetti finalized a $5 million settlement
agreement with First Union National Bank (now Wachovia). In
the matter Smith, Estes, et al. v. First Union National Bank,
KT&T represented a class of investors defrauded by mutual fund
Cyprus Funds, which used First Union to handle its accounts.
As a result of an elaborate Ponzi scheme created by Cyprus Funds manager
Eric Bartoli, 531 investors--primarily retirees from Ohio and Latin
American business people--lost over $34 million. Transactions
which went through First Union included Bartoli's purchases of
a farm, livestock, and jewelry, all accomplished using investors'
money. First Union was accused by the class of aiding and abetting
Bartoli's fraud.
