We apologize for the informality of this letter and the imposing amount of materials being forwarded to you. John Kozyak, as Chapter 11 Trustee, and James Clarke, as Chairman of the Official Creditors Committee, urge you to carefully examine the enclosed Amended Disclosure Statement, together with its exhibits, and the Amended Chapter 11 Plan, including its attachments. The Trustee, with the full support of the Creditors Committee, is soliciting acceptances of the Plan from holders of Claims in the voting classes.
Only "impaired" Classes of Claims may vote on the Plan. These eligible, impaired Classes are Classes 3, 4, 5 and 6. The Trustee recognizes many of the terms used in the Disclosure Statement may seem confusing. Key words and terms are defined in the Plan and "impaired" means victims will not fully recover their investments and you are in one of these classes.
The Trustee and your Committee believe the Plan is in the best interests of all creditors. The Plan, as structured:
Allows creditors to participate in distributions equal to or greater than those which would be available if the Debtors liquidated under Chapter 7 of the Bankruptcy Code.
Maximizes distributions and minimizes uncertainties in recoveries to all creditors.
Provides for continued, effective coordination of the criminal restitution process.
We ask you to please follow the instructions for completing, signing and dating each ballot. Return it in the enclosed business reply envelope. To be counted, your ballot must be received by the ballot agent on or before June 4, 2001 at 5:00 p.m. If you have received more than one ballot, please return each ballot. Without your vote the trustee may not be able to confirm the plan on June 20, 2001 and that would delay the bankruptcy process, including distributions.
Please remember to indicate your vote for or against the Plan and to sign your ballot. A ballot without a vote, or a ballot without a signature, will not count.
We thank you for giving careful consideration to the Plan and for cooperating in the voting process.
The Trustee and the Committee are not finished and will keep working after June 20, 2001 to recover more monies for you for future distributions. This Plan is a significant step.
