CONFIRMATION
This page contains information on the Trustee's Amended Chapter 11 Plan and Disclosure Statement filed April 25, 2001, and the hearing on confirmation of the Plan scheduled for June 20, 2001.
John Kozyak, as the Chapter 11 Trustee of FinFed and ABS, has prepared and filed a Chapter 11 Plan. The Plan is the Trustee's proposal for how to recover, liquidate and distribute the assets of FinFed and ABS for the benefit of their creditors.
The Trustee also has prepared a Disclosure Statement, the purpose of which is to provide creditors with adequate information to enable them to make an informed judgment about the Plan. The Bankruptcy Court entered an Order approving the Disclosure Statement on April 25, 2001.
All creditors whose claims are impaired under the Plan (including creditors whose claims arise by virtue of funds provided for direct or indirect investment in viatical settlement purchase agreements, other unsecured creditors, and brokers) are entitled to vote on the Plan.
All persons who are entitled to vote on the Plan will receive copies of the Balloting Packages (including the Ballot, Disclosure Statement and Plan). The Balloting Packages will be mailed by May 4, 2001. If you believe you are entitled to vote on the Plan and have not received a Balloting Package by May 14, 2001, or if your Balloting Package is missing any items, please contact the FinFed Balloting Agent at 1-800-791-9050. PLEASE DO NOT CALL BEFORE MAY 14, 2001 TO ALLOW TIME FOR THE BALLOTING PACKAGE TO ARRIVE BY MAIL.
Once you receive the Balloting Package, please send in your ballot as soon as possible. For your vote to count, your ballot must be received by the FinFed Balloting Agent, ClaimTrack Services Group, P.O. Box 600488, Jacksonville, Florida 32260 by June 4, 2001.
A hearing on confirmation of the Trustee's Plan is scheduled for June 20, 2001 at 9:30 a.m. You are welcome, but not required, to attend. Any objections to the Plan must be filed and served by June 4, 2001.
