After only two days of trial in U.S. Federal Court in Ft. Lauderdale,
KT&T attorneys Harley Tropin and Tucker Ronzetti finalized a
$5 million settlement agreement with First Union National Bank (now
Wachovia). In the matter Smith, Estes, et al. v. First Union National
Bank, KT&T represented a class of investors defrauded by mutual
fund Cyprus Funds, which used First Union to handle its accounts.
As a result of an elaborate Ponzi scheme created by Cyprus Funds
manager Eric Bartoli, 531 investors--primarily retirees from Ohio
and Latin American business people--lost over $34 million. Transactions
which went through First Union included Bartoli's purchases of a
farm, livestock, and jewelry, all accomplished using investors'
money. First Union was accused by the class of aiding and abetting
Bartoli's fraud.

John Kozyak was part of a team of Assistant U.S. Attorneys, FBI
and IRS agents, which was presented the National Crime Victims Service
Award by Attorney General Ashcroft on April 22, 2004, during the
federal commemoration of National Crime Victims Rights Week. John
served as restitution receiver in the U.S. v. Brandau et al. case,
where Mr. Brandau was sentenced to 55 years in prison. He was also
the bankruptcy trustee for Financial Federated, the company used
to promote a large Ponzi Scheme, involving viatical contracts, resulting
in 3400 victims losing $134 million. John Kozyak, KT&T and the
government helped the victims recover approximately 20% of their
investments and kept them informed of developments in this complicated
case, through frequent, comprehensive status reports and a website.
