After only two days of trial in U.S. Federal Court in Ft. Lauderdale, KT&T attorneys Harley Tropin and Tucker Ronzetti finalized a $5 million settlement agreement with First Union National Bank (now Wachovia). In the matter Smith, Estes, et al. v. First Union National Bank, KT&T represented a class of investors defrauded by mutual fund Cyprus Funds, which used First Union to handle its accounts. As a result of an elaborate Ponzi scheme created by Cyprus Funds manager Eric Bartoli, 531 investors--primarily retirees from Ohio and Latin American business people--lost over $34 million. Transactions which went through First Union included Bartoli's purchases of a farm, livestock, and jewelry, all accomplished using investors' money. First Union was accused by the class of aiding and abetting Bartoli's fraud.

John Kozyak was part of a team of Assistant U.S. Attorneys, FBI and IRS agents, which was presented the National Crime Victims Service Award by Attorney General Ashcroft on April 22, 2004, during the federal commemoration of National Crime Victims Rights Week. John served as restitution receiver in the U.S. v. Brandau et al. case, where Mr. Brandau was sentenced to 55 years in prison. He was also the bankruptcy trustee for Financial Federated, the company used to promote a large Ponzi Scheme, involving viatical contracts, resulting in 3400 victims losing $134 million. John Kozyak, KT&T and the government helped the victims recover approximately 20% of their investments and kept them informed of developments in this complicated case, through frequent, comprehensive status reports and a website. This award was given in recognition of Johns ongoing commitment to developing and fostering minority mentoring programs for law students, as well as his leadership in many other community service efforts. The presentation was held at the Bar Associations 26th Annual Scholarship Banquet at the Eden Roc Resort & Spa on Miami Beach.

was inducted into Iron Arrow at the University of Miami Law Schools 55th Homecoming festivities. This is the highest honor that can be attained at the University of Miami, and Harley joins fellow KT&T Partners Laurel Isicoff and Tucker Ronzetti who were previously tapped for this distinction.

MINORITY MENTORING

For the past fifteen years, Kozyak Tropin & Throckmorton, has had a major role in promoting mentoring for black law school students at the University of Miami and, more recently, at other law schools in Florida and Washington School of Law in St. Louis.

The minority mentoring programs at the University of Miami School of Law and St. Thomas University School of Law are now named after founding partner and diversity advocate, John Kozyak. At the beginning of each school year, John attends the Black Law Student Association's initial meetings and encourages all students to take advantage of the numerous lawyers and judges who have volunteered to serve as mentors. Students complete a simple application and send John their resumes. He then personally matches them with a mentor who usually practices in the field most interesting to the student. However, some of the best matches result from being introduced by John at bar functions.

Mentors and students are expected to communicate regularly and John regularly e-mails them to invite them to meetings, receptions, and other functions.

KT&T also actively supports mentoring for all minority students. Partner, Corali Lopez-Castro, is President of the Cuban-American Bar Association, which provides mentors for students throughout the state. Detra Shaw-Wilder is the immediate past President of the Gwen S. Cherry Black Women's Association, which mentors students. Other lawyers serve as mentors through programs sponsored by the Florida Association of Women Lawyers.

The highlight of the minority mentoring program for the past two years is the Minority Mentoring Picnic, which has been organized by John Kozyak and the firm. Every conceivable bar association supported last year's picnic, which attracted approximately one thousand students, judges, and lawyers including Florida Supreme Court Justice Peggy Quince and former Attorney General Janet Reno.
